Remove Frank Capone

It's time to stop the harassment!

The membership of the Potomac Yard HOA is holding a vote on the immediate removal of board member Frank Capone, who has another year left in his term. The board approved this vote after 60 homeowners, and growing, signed a petition calling for Capone's removal because of his harassing and disruptive behavior.

We believe Frank Capone's behavior is inappropriate and abusive

The other four board members have voted unanimously to reprimand Frank Capone for violating the HOA's Code of Conduct policy five times since the policy went into effect September 1 - for harassing the community manager, refusing to sign the policy, improperly using social media and spreading inaccurate information (twice).

Frank Capone is driving up the HOA's legal bills

Frank Capone's complaints and constant lawsuit threats are contributing to the HOA's rising legal costs. The legal budget is quintupling from $20,000 this year to $100,000 next year.

Capone has partnered with homeowner Nicholas Panos, who is suing the HOA in Alexandria Court, on multiple efforts to challenge the HOA's authority to perform basic functions like landscaping and snow shoveling throughout the community. (They're even opposed to money spent on repairing mailboxes!)

Panos has sent multiple notes (threat 1 and threat 2 Source: Potomac Yard HOA Books and Records Request) to the HOA saying he and Capone are in this effort together, and he has admitted that Capone has been feeding him information from (candidate townhall meeting starting 00:50:10-00:51:14) the HOA's back-office systems accessible only to board members to help his lawsuit.

Frank Capone has been filing a constant series of Association complaints and books and records requests (September and October) that require the HOA to seek advice from legal counsel, driving up costs. Many of these requests reflect Capone's personal vendettas against individuals in the community and contain false accusations that individuals have been improperly benefiting from having dead bushes replaced in the landscaping outside of their homes. Since the board started releasing this information publicly at the beginning of September, he's filed 15 records requests and two complaints, most of which have been dismissed.

Here's how to remove Frank Capone from the Potomac Yard HOA Board

All homeowners in the Potomac Yard HOA will receive an email from Association Voting with a link to the ballot. (ALL homeowners in PY can vote - Townhomes, Condo I, Condo II, Powhatan and the Dylan.)

Vote YES to remove Frank Capone.
